At Bear Bogging Adventure Tours we offer the most up to date equipment which is all dealer maintained. Each item is tested and inspected on a regular basis. That being said, we cannot accept responsibility for things that happen that are beyond our control.
You agree to inspect the equipment prior to taking possession for any damage or defects and must report any to us. Any damage or defects found upon return that are not known prior to the start time are assumed to be your responsibility. You are also responsible for any lost or stolen items including keys, helmets and the vehicles themselves. For more details view our full Terms and Conditions.
Assumption of Risk
You acknowledge that activities surrounding the use of our rental equipment in Wisconsin can be a dangerous activity and you agree to personally assume all risk and liabilities. You also agree that you will not sue us for any reason, repeat you agree that you will not sue us for any reason.
At Bear Bogging Adventure Tours we expect you to use the equipment in a safe and proper manner. The driver agrees and states he/she will comply and follow all Wisconsin laws for operating a UTV/RZR/sidexside or any rental unit. Driver also agrees to familiarize themself with the equipment, inspect the equipment before use, all passengers wear a helmet and appropriate safety gear when appropriate, the driver agrees not to use drugs or alcohol during the rental period, pay attention to posted signs and your surroundings and follow all Wisconsin Department of Natural Resources regulations.
Damage Deposit / Insurance Policy
A Damage Deposit of $1500 is required for each vehicle rented. In addition, each Renter is provided the opportunity to purchase insurance for $24.50 prior to the start time. The insurance covers damage to our equipment greater than the amount of the Damage Deposit. If you choose not to purchase insurance a larger Damage Deposit is required.

BEAR BOGGING ADVENTURE TOURS PROVIDES NEW DEALER MAINTAINED EQUIPMENT. THAT BEING SAID, RENTER ACKNOWLEDGES THAT BEAR BOGGING ADVENTURE TOURS MAKES NO WARRANTY OF ANY KIND, NATURE, OR DESCRIPTION, EXPRESS OR IMPLIED, AS TO THE QUALITY OF MANUFACTURE, SAFETY, OR FITNESS FOR ANY PARTICULAR PURPOSE OF ANY EQUIPMENT THAT IS THE SUBJECT OF THIS AGREEMENT. RENTER AGREES TO INSPECT THE EQUIPMENT PRIOR TO THE START TIME AND TO NOTIFY OFF ROAD RENTALS OF ANY DAMAGES TO, OR PROBLEMS WITH, THE EQUIPMENT. IF RENTER RETURNS THE EQUIPMENT TO BEAR BOGGING ADVENTURE TOURS IN A DAMAGED CONDITION, AND BEAR BOGGING ADVENTURE TOURS WAS NOT NOTIFIED OF SUCH DAMAGE PRIOR TO THE START TIME, RENTER AGREES TO BE RESPONSIBLE FOR ANY SUCH DAMAGE.
ASSUMPTION OF RISK
RENTER AND ALL PASSENGERS ACKNOWLEDGES AND AGREES THAT OPERATION OF THE EQUIPMENT ON ATV/UTV TRAILS IN WISCONSIN IS A DANGEROUS ACTIVITY, WITH A HIGH RISK OF SERIOUS BODILY INJURY OR DEATH TO THE RENTER, TO OTHERS AND TO PROPERTY. RENTER EXPRESSLY AND VOLUNTARILY AGREES TO PERSONALLY ASSUME ALL RISKS AND LIABILITIES ASSOCIATED WITH THE OPERATION OF THE EQUIPMENT, INCLUDING BUT NOT LIMITED TO LOSS OR DAMAGE TO THE EQUIPMENT AND THE DEATH OR INJURY TO ANY PERSON OR PROPERTY. RENTER ACKNOWLEDGES AND AGREES THAT RENTER AND ALL RIDERS UNDERSTANDS, BY EXECUTION OF THIS AGREEMENT, RENTER AND RIDERS IS WAIVING IMPORTANT LEGAL RIGHTS IN GOOD FAITH IN ORDER TO RELIEVE AND RELEASE BEAR BOGGING ADVENTURE TOURS OF CERTAIN DUTIES THAT BEAR BOGGING ADVENTURE TOURS MAY LEGALLY OWE TO RENTER IN CONSIDERATION FOR RENTING THE EQUIPMENT.
COVENANT NOT TO SUE
RENTER AGREES, ON BEHALF OF RENTER/RIDER AND RENTER’S RIDERS SUCCESSORS, HEIRS AND ASSIGNS, THAT RENTER WILL NOT, DIRECTLY OR INDIRECTLY, INSTITUTE ANY LEGAL, EQUITABLE, ADMINISTRATIVE, OR OTHER ACTION, COMPLAINT, OR PROCEEDING AGAINST BEAR BOGGING ADVENTURE TOURS OR ANY MEMBER, GOVERNOR, OFFICER, OR SUCCESSOR OR ASSIGNS THEREOF, OR IN ANY MANNER ASSERT ANY FURTHER CLAIM OR DEMAND AGAINST BEAR BOGGING ADVENTURE TOURS AND ITS MEMBERS, DIRECTORS, OFFICERS, OR SUCCESSORS AND ASSIGNS THEREOF, ARISING FROM OR PERTAINING TO THE CONDITION, POSSESSION, USE, AND/OR OPERATION OF THE EQUIPMENT, EXCEPT IF CAUSED BY THE INTENTIONAL, WILLFUL, OR WANTON ACTS BEAR BOGGING ADVENTURE TOURS. THIS COVENANT SHALL APPLY AND EXTEND TO ANY AND ALL CLAIMS, LIABILITIES, INJURIES, EXPENSES, LOSSES, DAMAGES, AND CAUSES OF ACTION THAT RENTER/RIDERS DOES NOT PRESENTLY ANTICIPATE, KNOW, OR SUSPECT TO EXIST, BUT THAT MAY DEVELOP, ACCRUE, OR BE DISCOVERED IN THE FUTURE.
WAIVER AND RELEASE OF CLAIMS
RENTER, ON BEHALF OF RENTER AND RENTER’S SUCCESSORS, HEIRS, AND ASSIGNS, HEREBY WAIVES, RELEASES, AND DISCHARGES Bear BEAR BOGGING ADVENTURE TOURSITS MEMBERS, DIRECTORS, OFFICERS, AND SUCCESSORS OR ASSIGNS THEREOF, FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, LOSSES, EXPENSES, DAMAGES, LIABILITIES, ACTIONS, CAUSES OF ACTION OF ANY NATURE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, WRONGFUL DEATH, AND PROPERTY DAMAGE, THAT ARISES FROM OR RELATES TO THE RENTAL, USE AND/OR OPERATION, CONDITION, OR POSSESSION, OF THE EQUIPMENT, EXCEPT IF CAUSED BY THE INTENTIONAL, WILLFUL, OR WANTON ACTS OF Bear Bogging Adventure Tours. THIS WAIVER AND RELEASE SHALL EXTEND TO, AND INCLUDES, ANY AND ALL CLAIMS, LIABILITIES, INJURIES, DAMAGES, AND CAUSES OF ACTION THAT RENTER DOES NOT PRESENTLY ANTICIPATE, KNOW, OR SUSPECT TO EXIST, BUT THAT MAY DEVELOP, ACCRUE, OR BE DISCOVERED IN THE FUTURE.
RENTER AGREES THAT RENTER SHALL INDEMNIFY, DEFEND, PROTECT, AND HOLD BEAR BOGGING ADVENTURE TOURS, ITS MEMBERS, DIRECTORS, OFFICERS, AND SUCCESSORS AND ASSIGNS THEREOF, HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, PENALTIES, LOSSES, OR EXPENSES (INCLUDING ATTORNEYS’ FEES) FOR DEATH OF OR INJURY TO ANY PERSON, OR DAMAGE TO ANY PROPERTY WHATSOEVER, ARISING FROM OR CAUSED IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE RENTAL, USE AND/OR OPERATION, CONDITION, OR POSSESSION OF THE EQUIPMENT, EXCEPT IF CAUSED BY THE INTENTIONAL, WILLFUL OR WANTON ACTS OF Bear Bogging Adventure Tours.
Rules of Operation.
Renter acknowledges receipt of the Rules of Operation attached to our Rental Agreement, and thereby incorporated therein, and agrees that the Equipment will be operated by Renter as indicated therein. Renter agrees that Renter will not allow any other persons to operate the Equipment and that Renter is solely responsible for the proper operation thereof.
Choice of Law. Renter agrees that if any provision contained in this Agreement shall be held invalid or unenforceable by any court of competent jurisdiction, the remaining provisions of this Agreement shall remain enforceable. This Agreement shall be governed and construed under the laws of the State of Wisconsin.
Renter agrees that our Rental Agreement, including the attached Rules of Operation, with these Terms and Conditions, constitutes the entire agreement between Renter and Bear Bogging Adventure Tours. No provision hereof shall be modified or rescinded unless in writing signed between Renter and Bear Bogging Adventure Tours.
Wisconsin DNR Safety Training
Renter represents and warrants to Bear Bogging Adventure Tours that if Renter was born after July 1, 1987, Renter has completed all required Wisconsin Department of Natural Resources ATV/UTV Safety Training and is properly certified to operate the Equipment.
Rules of Operation
Each Renter will complete and execute a Rental Agreement and Waiver of Liability subject to our Terms and Conditions prior to taking possession of any rental vehicle.
Renter will familiarize themselves with the use of the throttle, breaks, 4x4 operation, parking breaks and gauges plus, fuel and fuel types and other fluids.
Before commencement of each use Renter must check the fuel, fluids, tires, vehicle’s lights, breaks and parking breaks and ensure working order of the throttle. If any part of the pre-trip inspection fails, the vehicle(s) must not be operated and Renter must notify Bear Bogging Adventure Tours.
Renter and all riders must wear DOT approved safety helmets properly fitted and sized without damage at all times while operating equipment. Additionally, gloves, goggles, long pants, long sleeve shirt or jacket, and over the ankle boots can reduce risk of injury.
Seatbelt(s) and safety nets (if applicable) must be used by all parties when vehicle is in operation.
Renter will not leave vehicle unattended while the motor is running.
Alcohol, illegal drugs and prescription or over-the-counter medications that may interfere with the safe operation of the vehicle are strictly prohibited while machine is in use and during the duration of the Rental Agreement.
Obey all posted signs. Do not ride faster than posted speed limits. Ride at your current skill level. Don’t push your limits. Be aware of your surroundings and be careful! Use equipment according to guidelines in the WI DNR regulations.
